The Federal Circuit said a district judge was too hasty in rejecting Lenovo Inc.‘s bid to halt smart-phone sales bans sought in South America by the Swedish telecom giant Ericsson.
Ericsson sued Lenovo in a North Carolina federal court in October 2023 after licensing negotiations over its standard essential 5G patents had broken down. It argued its offer seeking 1% of Lenovo’s net sales on 5G phones and tablets was fair and reasonable, in accordance with the rules of French standard-setting organization ETSI.
