Peru’s Attorney General: Claim regarding law on crimes against humanity to be filed soon | Noticias

on Friday announced that work is underway to prepare unconstitutionality claims regarding the law on crimes against humanity and the regulation that modifies the fight against organized crime, which will be presented soon.

Both regulations have been deemed controversial and criticized by other State institutions, academic authorities, and NGOs.

Through separate statements, the Board of Supreme Prosecutors agreed to file unconstitutionality claims regarding the law that specifies the application and scope of crimes against humanity and war crimes; and the regulation that modifies the classification of organized crime.

“We are working on this issue (law on crimes against humanity), and we hope to address it as soon as possible. Yet I cannot give an exact date, but we will proceed as quickly as we can,” Villena told RPP Noticias.

“We will also file a claim regarding the rules that regulate (against) organized crime, which has been widely discussed, and the damage it causes, but we are still analyzing and working on that other issue,” he added.

Villena indicated that the Public Prosecutor’s Office also responded to the unconstitutionality claim filed by the Ombudsman’s Office against the forfeiture of assets rule, indicating that it could hinder the work being done in the fight against organized crime.

“Peru is a benchmark in this area in Latin America, because large amounts of money from crimes and other illegal activities have been recovered. These limitations can indeed prevent such resources from being recovered, thereby undermining the work of justice,” he explained.

He added that a total of 30 constitutional complaints were filed with Congress against different authorities during the first half of 2024.

In Peru, the Public Ministry-Attorney General’s Office is independent from any branch of government.
