Gabriela Leylanie Cabán Cruz of Aguadilla, Puerto Rico has died. She was 13.
Caban is one of the three children of Melanie Cruz Clivilles, 31, of Aguadilla. Cruz has two sons born in 2012 and and 2017.
On November 19, 2023, Caban escaped from a Departamento de la Familia home in Quebradillas, Puerto Rico. On November 22, 2023, she was found in Aguadilla and was later relocated to Cruz’s home.
In July 2023, Cruz met Bryan Xavier Pérez Hernández, 26, of San Sebastián, Puerto Rico. It has yet to be confirmed whether or not that was the first time Cruz and Perez met.
On August 3, 2023, Cruz and Perez had a meeting. On August 4, 2023, he arrived at the Pepino Health Group in San Sebastián, Puerto Rico with the deceased body of Caban.
Cruz lied by telling a task force officer of the U.S. Department of Homeland Security Investigations (HSI) that she first met Perez on August 4, 2023 at the hospital where he arrived with her deceased daughter. Perez went to authorities to report that two individuals had kidnapped him in La Piedra, Saltos, San Sebastian.
With the help of the Puerto Rico Crimes Against Children Task Force (PRCACTF) and the Puerto Rico Police Bureau (PRPB), HSI arrested Perez and Cruz for charges related to Caban’s death. Cruz was charged with lying to a federal law enforcement agent and is facing up to five years in prison.
Perez was charged with attempting to induce, entice, and coerce a minor to engage in sexually explicit conduct for the purpose of producing child exploitation material, possession with intent to distribute cocaine, conspiracy to distribute cocaine and distribution of cocaine to a minor. If convicted, he faces up to 40 years in prison for the drug trafficking charges and a statutory minimum sentence of between 15 and 30 years in prison for production of child pornography.
HSI and the PRBP are investigating the case. HSI Child Exploitation and Immigration Unit chief Jenifer Y. Hernández-Vega is prosecuting the case.
