Alabama among 20 states seeking to defend Trump, DOGE in court

MONTGOMERY, Ala. (WSFA) – Alabama has joined 19 other states in filing a motion in U.S. District Court for the Southern District of New York aimed at defending the Trump administration and its controversial Department of Government Efficiency, or DOGE.

Alabama Attorney General Steve Marshall’s office said the state joined the motion to file an amicus curiae brief in support of President Donald Trump and DOGE from what is seen as “politically-motivated lawsuits attempting to stop his team from protecting taxpayer dollars.”

“The American people have been loud and clear: they want President Trump to cut waste, eliminate fraud, and protect their tax dollars,” Marshall said. “Yet, the radical left is using the courts to shield corruption and obstruct the President’s efforts.”

The 20 states filing the Iowa-led briefmaintain that Article II of the Constitution grants President Trump the authority to direct executive branch agencies. Those states includeIowa, Alabama, Arkansas, Florida, Georgia, Idaho, Indiana, Kansas, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Texas, and Utah.

Attorneys general in more than a dozen states are suing in an effort to challenge the authority of billionaire Elon Musk and actions being taken by those inside DOGE to access sensitive government data, the Associated Press reports. The AP noted that Musk’s team has roamed from agency to agency, tapping into computer systems, digging into budgets and searching for what he calls waste, fraud and abuse, while lawsuits pile up claiming the president and DOGE are violating the law.

“These baseless lawsuits are nothing more than a last-ditch effort to preserve a broken system,” Marshall said. “I stand firmly with DOGE and will continue fighting to ensure this administration can expose and eliminate the fraud that has plagued our federal government for far too long.”
