Musk’s daily $1 million payouts at Trump rally draw legal scrutiny

Billionaire Elon Musk promised to give away $1 million each day until November’s election to someone who signs his online petition pledging “support for the First and Second Amendments.”

Elon Musk is once again putting his money in the political arena.

With Election Day just 15 days away, the billionaire CEO of Tesla is offering registered voters in swing states the chance to win a million dollars by signing a petition to “guarantee freedom of speech and the right to bear arms.”

The petition was launched by America PAC, the group Musk set up to back former President Donald Trump in this reelection effort.

In order to sign Musk’s petition, you must be a registered voter and live in one of the seven swing states: Arizona, Georgia, Michigan, Nevada, North Carolina, Pennsylvania and Wisconsin, according to the America PAC website.

Tennessee voters are not eligible to participate.

It’s no secret that Elon Musk is an active supporter of the Republican party and Trump. Musk has donated more than $75 million to the Trump campaign, and has appeared alongside the former president numerous times.

What is Elon Musk’s petition?

The goal of the petition is to “get 1 million registered voters in swing states to sign in support of the Constitution, especially freedom of speech and the right to bear arms.”

Musk has pledged to give $1 million to a registered voter who signed his petition every day until Election Day. He gave away the first payment to John Dreher, who attended a rally supporting Trump in Harrisburg, Pennsylvania.

Can Tennessee voters sign the petition?

No. Registered voters in Tennessee are ineligible to sign the petition or to refer other individuals to show their support, according to the America PAC petition.

Only voters in swing states are eligible to sign.

Is Musk’s giveaway legal?

There has been skepticism surrounding the legality of Musk’s latest endeavor.

USA TODAY reported that the Justice Department’s election crimes manual says an unlawful bribe can be anything of monetary value, including lottery chances, that make it easier for people to vote or induce them not to vote. The definition doesn’t include a free ride to the polls.

Federal law also prohibits paying individuals to vote or to register to vote.

Brad Smith, a former chair of the Federal Election Commission, told the New York Times that because Musk is paying people to sign a petition, not to register to vote, he “comes out OK” 

When is Election Day?

Election Day is Nov. 5.

Early voting is open in Tennessee and will remain available until Oct. 31.
