An Arkansas law designed to get the state’s milk farmers more money for their wares survived two constitutional challenges but succumbed to a contract clause challenge in the end, a federal court said.
The evidence established that the Arkansas Milk Stabilization Act was “passed with the impermissible purpose of benefitting the narrow class of Arkansas dairy farmers out of the premiums negotiated” by their co-operatives such as the Dairy Farmers of America, Judge James M. Mood Jr. said Wednesday for the US District Court for the Eastern District of Arkansas.
