The US Supreme Court declined to review a drug industry group’s case against an Arkansas law that strips manufacturers’ ability to impose conditions on the use of pharmacies under a federal drug discount program.
The nation’s high court Monday denied the Pharmaceutical Research and Manufacturers of America’s petition to review a decision by the US Court of Appeals for the Eighth Circuit. The appeals court rejected the group’s preemption argument against Arkansas’ Act 1103, a law prohibiting drugmakers from refusing to supply discounted drugs to contract pharmacies.
