The Trump administration has taken steps to ensure all immigrants and foreigners inside America are registered with the federal government. Those who came without inspection and had no contact with the federal authorities during their years living in American cities will be required to register now compulsorily or face criminal penalties.
Even the legal immigrants who are already registered must now have proof of registration with them at all times. The new rules says that foreigners over the age of 18 are required to carry and maintain in their possession the documentation of registration that Department of Homeland Security issues once they have registered and shown up for fingerprinting (unless excused).
All unregistered foreigners in the United States are legally required to abide by these rules. There will be criminal and civil sanctions for noncompliance, including the possibility of misdemeanor prosecution and fines.
US has released a registration form and process for foreigners to complete the registration requirement. Beginning February 25, 2025, foreigners required to register need to create a USCIS online account in preparation for the registration process.
The Trump administration has revived a long-standing US immigration law requirement for immigrants to register with the federal government and provide proof of registration.
In his ‘Protecting the American People Against Invasion’ executive order, issued on January 20, 2025, President Trump instructed the Department of Homeland Security to make sure that foreign nationals fulfill their obligation to register with the government and to make sure that noncompliance is a priority for both civil and criminal enforcement.
Immigration and Nationality Act requires that, with limited exceptions, all foreigners 14 years of age or older who were not fingerprinted or registered when applying for a U.S. visa and who remain in the United States for 30 days or longer, must apply for registration and fingerprinting.
Also, within 30 days of turning 14, the previously registered immigrant child must apply for re-registration and be fingerprinted.
Foreigners who have already registered include Lawful permanent residents. Also, anyone who has been issued one of the documents designated as evidence of registration will be considered as registered. Also, anyone who submitted one of the designated forms and provided fingerprints and was not issued one of the pieces of evidence designated will be considered to have complied with the registration requirement.
However, all foreigners 14 years of age or older who were not registered and fingerprinted when applying for a visa to enter the United States and who remain in the United States for 30 days or longer must apply for registration. They must apply before the expiration of those 30 days.
The parents and legal guardians of foreigners less than 14 years of age who have not been registered and remain in the United States for 30 days or longer, prior to the expiration of those 30 days will also have to apply for registration.
Who is not registered?
Anyone who has not been issued one of the documents designated as evidence of registration and has not submitted one of the forms designated and provided fingerprints is not registered. Foreigners who have not registered include:
Foreigners who are present in the United States without inspection and admission or inspection and parole;
Canadian visitors who entered the United States at land ports of entry and were not issued evidence of registration; and,
Foreigners who submitted one or more benefit requests to USCIS, including applications for Deferred Action for Childhood Arrivals or Temporary Protected Status, who were not issued evidence of registration.
